If you have a valid complaint, there are people out there that will help you. Does your town have an TV investigative reporter? They love stories like this.

The Better Business Bureau has a program, online, that I have used several times with great success.

Give both a try, what do have to loose?

Did you check to make sure there wasn't an "R" on the package which means refurbished or factory-refurbished?

Even tho its factory-refurbished, you get the full warranty on a like-new item.

Now any store can sell you something damage in a new package box. It happens during shipment etc so don't assume they did it on purpose.

Just get it exchanged or refunded if it bothers you.

Also, it could have been a returned item so you never know.

actually this is fairly old news...I am quite aware that Best Buy likes to pass off used merchandise as new stuff! Which is why i refuse to shop there!!!
